COS26 Dialogue

The purpose of these Terms and Conditions is to set out the contractual basis for your relationship with the Chief of Staff Association as it pertains to COS26: The Global Chief of Staff Dialogue and to draw your attention to key terms.Your contract with us is made up of:

Conditions of your contract with the Chief of Staff Association1. Upon paying your full fees you enter into a contract with the Chief of Staff Association.2. You will enter into this contract with the Chief of Staff Association even if your fees are paid by a third party on your behalf.3. It is a condition of your contract that any information submitted with or in relation to your registration is true, accurate and complete (i.e., does not omit information you have been asked to provide).4. You may be excluded from some or all of COS26 if the Atlantic Council or the Chief of Staff Association considers that you are in breach of any of these rules.Your responsibilities5. It is your responsibility:a) to act as a responsible member of the Chief of Staff Association and Atlantic Council's community, including treating other members of the community, fellow delegates and the public with courtesy and respect.b) to comply with any measures or instructions given by the Atlantic Council or the Chief of Staff Association to reduce risk of transmission of any illness or to safeguard health during a pandemic (including Covid-19), epidemic or local health emergency. Without limiting that general obligation, reasonable measures may include imposing specific requirements regarding personal protective equipment such as the wearing of masks, or specific safety measures such as use of sanitiser or distancing procedures. You must also immediately declare to Atlantic Council staff and the Chief of Staff Association if you have, or suspect you may have, symptoms of Covid-19 (or any other serious infectious illness), or if you have received a positive test result for Covid-19, comply with the period of self-isolation required by government, and comply with any other distancing or health and safety measures in place, as updated from time to time.c) to comply with any other reasonable instructions in relation to the delivery of COS26 (e.g., other health and safety requirements, confidentiality, use of devices in sessions and complying with licence terms on event materials).d) to attend all sessions, arrive promptly, carry out all relevant preparation and engage fully with event activities.6. If you fail to comply with clause 5 without proper reason, you may be excluded from sessions or from COS26 as a whole (and required to notify your funder if your fees are being paid by a third party) to ensure your behaviour does not have a detrimental effect on other delegates. If you are excluded from COS26, or if (without reasonable excuse) you do not attend all sessions, you will not receive a certificate of attendance. No refunds will be payable where you are excluded from COS26, or any sessions, in these circumstances.Fees and payment7. The Chief of Staff Association reserves the right to refuse you admission to COS26 if you have not paid all registration and event fees before the event starts.8. All payments must be in USD (United States Dollars). You must pay any currency conversion costs or other charges incurred in making the payment or in processing a refund.9. Discount codes issued by the Chief of Staff Association for member pricing are available exclusively to individuals who hold a current, active membership of the Chief of Staff Association at the time of purchase. Membership discount codes may not be used on behalf of, or transferred to, any other individual. Guests or nominees of members are not eligible for member pricing and must purchase tickets at the full published rate.10. The Chief of Staff Association reserves the right to verify membership status at any time. Where a discount code has been applied by an individual who does not hold a current, active membership, the Chief of Staff Association reserves the right to cancel the booking or require payment of the difference between the discounted and full ticket price before confirming the place.Cancellation by delegates11. There is a no refund policy for tickets purchased for this event. 12. As an alternative to cancellation, you may transfer your place to a named substitute delegate at no additional charge, provided written notice of the substitution — including the full name, job title, and contact details of the substitute — is received by the Chief of Staff Association at events@csa.org no later than five business days before the event. The Chief of Staff Association reserves the right to decline a substitution where the proposed delegate does not meet the eligibility criteria for attendance.Cancellation by us13. Insofar as reasonably possible, if a pandemic (including but not limited to Covid-19), epidemic, local health emergency, fire, flood, explosion, lockouts, strikes or other industrial disputes, protests, riots, civil disturbance, war or national emergency, acts of terrorism, acts of government or acts of God means that COS26 needs to be cancelled, the Chief of Staff Association will notify delegates as soon as practicable and will give you the opportunity to:a) transfer to a rescheduled COS26 event at a later date, subject to availability.14. The Chief of Staff Association's liability when it cancels COS26 will be limited to a refund of any fees or charges paid. For partial cancellation, such refunds will be made on a proportionate basis.Changes to the event15. The Chief of Staff Association will seek to deliver COS26 in accordance with the description set out on the event web page.16. However, there may be situations in which it is desirable or necessary for the Chief of Staff Association to make changes to COS26, either before or after registration. The Chief of Staff Association therefore reserves the right to:a) make reasonable changes to the timetable, location or speakers; andb) make reasonable changes to the content of the event.17. Where a pandemic (including but not limited to Covid-19), epidemic or local health emergency necessitating measures to reduce risk of infection or illness arises or has already arisen, the Atlantic Council or the Chief of Staff Association may make such changes as it reasonably deems necessary to comply with government or local authority regulations or guidance, and/or its own health and safety advice and/or to ensure the health and safety of staff, delegates and third parties and/or to respond to consequential staffing or resource constraints. Examples of measures the Atlantic Council or the Chief of Staff Association may take in such circumstances include:a) moving the location of the event and/or restricting numbers permitted to attend any location at one time;b) changing the times of scheduled sessions, including evenings or weekends;c) requiring delegates to comply with:i. social distancing measures; ii. the wearing of face masks; iii. the wearing of personal protective equipment; iv. other health and safety measures deemed necessary.d) varying, limiting or cancelling access to some services or facilities.18. The Chief of Staff Association will ensure that, when making changes as a result of a pandemic (including Covid-19), epidemic or local health emergency, the key objectives of COS26 will still be met. The scope of the Chief of Staff Association's right to make changes under clause 16 of these Terms and Conditions should be construed accordingly.19. Save as set out expressly above, no refunds, discounts, damages or waivers of event fees or other charges will be payable to you where changes or delays have resulted from, been caused by, or are in relation to a pandemic (including but not limited to Covid-19), epidemic or local health emergency necessitating measures to reduce risk of infection or illness. Furthermore, the Atlantic Council and the Chief of Staff Association will not be liable for any consequential losses or expenses you may incur (e.g., travel or accommodation costs) as a result.Events beyond our control20. The Chief of Staff Association will not be in breach of its obligations under its contract with you, nor liable to you for any loss caused to you, which results from events beyond the Chief of Staff Association's reasonable control, such as: a pandemic (Covid-19 or otherwise), an epidemic or a local health emergency necessitating measures to reduce risk of infection or illness; industrial action; acts of God; acts of terrorism; or failure or delay by third party suppliers and subcontractors.Complaints procedure21. If you have a complaint you should submit details to events@csa.org.Termination22. Your contract with the Chief of Staff Association will end in the following circumstances:a) when you complete your attendance at COS26, or if you cancel or withdraw your registration;b) if the Chief of Staff Association exercises its right to cancel COS26;c) if you are excluded from COS26 under clause 5; ord) if you fail to comply with the provisions above.23. The following terms will survive termination of your contract with the Chief of Staff Association for any reason:a) terms relating to personal data as described in the Chief of Staff Association's terms page (https://www.csa.org/terms).Jurisdiction24. Your contract with the Chief of Staff Association and any dispute arising from it (including non-contractual disputes) shall be governed by the laws of the United States of America and the State of New York and are subject to the mandatory arbitration provisions set out in the Chief of Staff Association's general terms and conditions.
